1. Guidelines Overview
1.1 The compilation (meaning the collection, arrangement and assembly) of all content on www.hotjobs.com and www.hotjobs.yahoo.com (together, the “Site”) is the exclusive property of Monster Worldwide, Inc. (“Monster+HotJobs”), and is protected by U.S. and international copyright laws. Monster+HotJobs does not claim ownership of content submitted to or made available for inclusion on the Site. Monster+HotJobs is the sole interpreter of these guidelines and may change these rules at any time. Additionally, Monster+HotJobs may remove content from the Site at any time.
1.2 These guidelines cover jobs, résumés, profiles, cover letters, job applications and any and all communications among users of the Site (including, but not limited to employers, recruiters, advertisers and job seekers). For additional information and restrictions, see Monster+HotJob's Terms of Service regarding member conduct, http://hotjobs-employer.monster.com/terms/info3.aspx.
1.3 The terms “Employer” and “Recruiter” refer to users who post, or attempt to post, a job or other listing on the Site. They also refer to any user with an active account on the Monster+HotJobs Recruitment Center website (“RC”), or anyone given valid and authorized access to such an account by a valid user or company. “Advertisers” refers to any entity, including a sole proprietorship that has placed, or is attempting to place, advertising on Monster+HotJobs. “Content” refers to the elements of the Monster+HotJobs and/or RC websites including but not limited to articles, photos, icons, profiles, and comments. The term “Job Seeker” refers to any user of the Site.
1.4 The Site may be used only for lawful purposes. If you direct job seekers to leave the Site, you permit Monster+HotJobs to frame any of the materials or information to which you link such job seekers.
1.5 Failure to follow any of the guidelines contained herein could result in one or more of the following:
- low ranking of the posted job or résumé in our search engines,
- changes to your content and data by Monster+HotJobs,
- removal of your content from the site,
- account suspension, and/or
- permanent removal of the offending account from the site.
2. Employer, Recruiter, and Advertiser Guidelines
2.1 Job Listing Guidelines
2.1(a) Job postings must be for individual job openings for traditional W-2 or 1099 employees being paid a regular (i.e., weekly, bi-weekly, monthly, or annual) salary that exceeds the greater of the U.S. minimum wage or the minimum wage of the locality where the job is based. Business and training opportunities are not considered jobs and may not be posted with job postings purchased after August 24, 2010. Requirements for posting these types of opportunities are defined below in Section 2.4 (“Disclosure of Job Details and Non-standard Jobs”).

2.1(c) The following practices are prohibited:
- Advertising more than one position within a single job slot or job posting.
- Use of the following html tags/text formatting options: hidden text, text the same or similar color as the background, text placed behind an object or graphic, text in a font that is smaller than 9 point, or any other method intended to shield or hidetext. Using marquee, scroll, or hide tags in a job listing or company profile is also prohibited.
- Keyword spamming. Keyword spamming is defined as adding multiple, unrelated job titles, job categories, and keywords to a job description. Only job titles, categories, and keywords that directly relate to the job being described may appear in the job description.
- Category spamming: Category spamming is defined as posting a job under categories that do not relate directly to the job being described in the job post.
- Improper use of intellectual property: You many not post any copyrighted material unless you own the copyright or have the owner's written permission to post the material. A job posting cannot contain trade secrets unless you own them or have the owner's written permission to post them. A job posting cannot contain material that infringes on or misappropriates any intellectual property rights, or violates the privacy or publicity rights of others
- Posting or including anything that is discriminatory, sexually explicit, obscene, libelous, defamatory, threatening, harassing, abusive, or hateful. A job posting may not contain anything that could reasonably be considered embarrassing or offensive to a person or entity.
- Posting false, inaccurate, or misleading information.
- Posting jobs with insufficient information to clearly convey the nature and requirements of the job. Jobs that encourage the user to "e-mail for more details" are not permitted.
- Deleting and re-posting a job for the purpose of making it appear new. If the intent is to make the job look new, the refresh feature should be used.
- If you have posted your job using the Monster+HotJobs Apply Now process, it is prohibited to ask users to apply through another application method, such as a link to your company website.
2.1(d) In order to prevent inadvertent use of Recruiter contact information by persons other than active Job Seekers, Monster+HotJobs advises Recruiters to not list e-mail addresses or other contact information in job descriptions. Please use the Contact Information field instead. If you want to use an e-mail address, use an e-mail alias that does not reveal a personal e-mail address, business e-mail address, or RC user ID.
2.2 Site Usage Guidelines
2.2(a) The following guidelines refer to general usage of the Site and accurate self-representation. The following actions are prohibited:
- Impersonating Monster+HotJobs. All Site elements including text, media, buttons, logos, and brand-names are for the exclusive use of Monster Worldwide, Inc. and/or Monster+HotJobs and are copyrighted and protected by copyright law. Companies posting on the Site may not copy, re-use, or alter any Site elements. These elements may not be used within job descriptions or anywhere off the Site such as in company communications, e-mail, etc. It is illegal for individuals, companies, or other organizations to represent themselves or communicate with others in a way that makes them appear to be part of Monster Worldwide, Inc. or Monster+HotJobs.
- Aggregating, copying, or duplicating in any manner any of the materials, data, or information available from the Site.
- Company profiles that misrepresent the actual identity of the company that is offering employment. Posting a listing confidentially is acceptable. In the case of staffing firms, company profiles can be used to represent only the staffing firm itself or companies for which the firm is actively recruiting. Using allocated job listings for purposes other than to list available jobs at your company or, in the case of staffing firms, available opportunities that the staffing firm has been engaged to fill, is prohibited.
- Disclosing to or sharing with any other person or entity your password that allows access to a non-public area of the Site or using your password for any unauthorized purpose.
- Framing of or linking to any of the materials or information available from the Site.
- Engaging in any action that may alter the appearance of the Site.
2.3 Résumé Search and HotHire™: Use&Restrictions
2.3(a) Companies that offer Non-standard Jobs may not access the résumé database or use HotHire™. Printing out or otherwise copying or using any personally identifiable information about candidates for purposes other than consideration of the candidates for potential employment or placement by your company or one that you directly represent, is prohibited.
2.3(b) All communication with potential Job Seekers through résumé search must pertain to a specific employment opportunity at your own company or one that you directly represent. Résumé search may not be used to solicit interest in business, commercial, training, or similar opportunities. Sending unsolicited e-mail or other communication to users is prohibited.
2.4 Disclosure of Job Details and Non-standard Jobs
2.4(a) Job listings are for traditional jobs and employment opportunities only as described above in Section 2.1 Job Listing Guidelines. All other listings including training, commercial offerings, and business opportunities must be posted under the "Business Opportunity" or "Job Search Aids" Categories. Classes and training opportunities may also be posted using job postings purchased prior to August 24, 2010.
2.4(b) A Business Opportunity is defined as any offering where payment is required to take advantage of the opportunity. Business Opportunities require an up-front payment, recurring payment, payment for registration, pay-to-apply listings, and/or any other form of payment for services. Commission-only jobs are considered Business Opportunities if any kind of up-front or recurring payment is required prior to getting those commissions. Business Opportunity listings must meet the following conditions:
- The listing must be posted in the Business Opportunity Category.
- The listing must use Direct Apply.
- The listing must describe the service or product that is to be sold.
- The payment must be in exchange for legitimate services and the user has to receive something of comparable value in return for payment.
- Pay-to-Apply listings must include the phrase “(Pay-to-Apply)” in the job title as well as in the first sentence of the job description.
- Work-from-Home Business Opportunities must include the phrase “(Work-from-Home)” in the job title as well as in the first sentence of the job description.
- Job listings involving payments must include the phrase “(Investment Required)” in the job title as well as in the first sentence of the job description.
- Posting any multi-level-marketing, "club membership," distributorship or sales representative agency arrangement, or other business opportunity which requires an up-front or periodic payment is prohibited. Exceptions may be made for postings that include "(Membership Payment Required)" in the job title and the first sentence of the job description. All terms and the amount of such payments must be clearly described and set forth in the job description (note: financial terms must be displayed in a clearly visible font, color, and in a size no smaller than 10 point).
2.4(c)Job Search Aids are defined as offerings for career related products or services. Job Search Aids include offerings for training, instructional materials, sales kits, and other job seeking services that are not direct opportunities for employment. Job Search Aids listings must be posted within the “Job Search Aids” category. Job Search Aids listings involving payments, must include the phrase “(Payment Required)” in the title and the first sentence of the description.
2.4(d)Commission-only jobs must include "(Commission-Only)" in the job title and first sentence of the job description. Commission-only jobs that require any kind of up-front or recurring payment are considered Business Opportunities and must meet the requirements set forth in section 2.4(b) above. All Commission-only jobs must clearly describe the product or service that the job seeker would be selling.
2.4(e) Any posting of a Non-standard job on the Site must comply with guidelines governing these offerings. Monster+HotJobs may use additional means to identify commercial offerings to its users through the use of icons, text alerts, and other warnings. In addition, Monster+HotJobs offers several ways for Job Seekers to report listings and companies suspected of job spam, scams, or other forms of abuse.
2.4(f) Prohibited Content:
- Specific types of listings that are prohibited from the site include the following financial scams (sometimes referred to as “419” scams) which may include but are not limited to,
- Soliciting a Job Seeker to act as a middleman to a transaction between two or more other parties.
- Check-cashing offers (offering Job Seekers a commission for cashing checks or money orders).
- Solicitation of bank account information, social security numbers,
- Solicitation of any other personal information that is not needed to review a candidate’s professional capabilities.
- Companies may not post any jobs on Monster+HotJobs for any competitor of Monster or post jobs or other content that contains links to any site competitive with Monster; (b) post jobs or content on Monster+HotJobs that contain hyperlinks, "hidden" keywords or keywords that are irrelevant to the job or are otherwise misleading; (c) post jobs for modeling or talent or talent scouting positions on Monster+HotJobs; post any franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (except for postings that make clear that the available job pays commission only and clearly describes the product or service that the job seeker would be selling, in which case such postings are permissible), or requires recruitment of other members, sub-distributors or sub-agents
Monster+HotJobs may remove any such listing(s) immediately and without notice.
3. Job Seeker and Résumé Guidelines
3.1 As with any Internet site or service, all Job Seekers should exercise caution when sharing personal information. Before responding to a job listing, please review our “Tips for a Safe Job Search,” which are available at: http://help.yahoo.com/l/us/yahoo/hotjobs/confidentiality/hotjobs-01.html
3.2 If you allow your résumé or profile to be searchable, then those individuals or entities that pay for access to the résumé database and/or HotHire™ and all prospective customers who are receiving a demonstration of our product will have access to your résumé. These individuals or entities have the ability to distribute your résumé to their own hiring systems via e-mail.
3.3 Job Seekers can store résumés and profiles in the Monster+HotJobs database, but set them as unsearchable by Employers and/or Recruiters. Not allowing a résumé or profile to be searchable means that it can be used to apply for a job online but it will not be searchable through the Job Seeker database. It can also be set as unsearchable by specific types of Recruiters such as staffing firms.
3.4 Résumés and applications must include sufficient information to clearly convey the nature of a Job Seekers’ qualifications as a candidate for employment.
3.5 The following are prohibited:
- Applying for jobs for which you are not reasonably qualified .
- Posting a résumé or profile of anyone other than you.
- Responding to job postings in any manner or for any purpose other than for that which it was intended (i.e., to initiate contact with a company for reasons other than applying to a job listing for yourself).
- Recruiters responding to a job posting on behalf of a candidate.
- Posting any incomplete, false, or inaccurate biographical information or misrepresenting any qualifications.
- Communication that encourages the Employer to "e-mail for more details."
- Sharing your password with others.
3.6 Failure to comply with these guidelines may result in the deletion of your résumé and/or profile or termination of your Monster+HotJobs account.
4. Site Access Methods, Bots, Hacking
4.1 Automated access to any and all Monster+HotJobs services requires the written consent of an authorized representative of Monster+HotJobs.
4.2 The following methods for accessing or interacting with the Site are prohibited:
- Use of any device, software, or routine to interfere or attempt to interfere with the proper working of the Site or any activity being conducted on the Site.
- Notwithstanding anything to the contrary contained herein, use or attempted use of any engine, software, tool, agent, or other device or mechanism (including without limitation browsers, spiders, robots, avatars, or intelligent agents) to navigate or search the Site other than the search engine and search agents available from Monster+HotJobs on the Site and other than generally available third-party web browsers (e.g., Firefox, Microsoft Internet Explorer, Apple Safari).
- Use of any means other than the interface provided by Monster+HotJobs.
- Any attempt to decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site.
- Deletion or revision of any material posted by any other person or entity.
- Any action that imposes an unreasonable or disproportionately large load on the Site's infrastructure.
5. Prohibited Communications
5.1 You may not post or transmit any unsolicited advertising, promotional materials, junk mail, “spam,” chain letters, telephone calls, or any other form of solicitation or any non-résumé information such as opinions or notices, commercial or otherwise to Employers, Recruiters, or Job Seekers
5.2 You may not spam Employers, Recruiters, or Job Seekers whose information appears on the Site.
6 Liability Limitations
6.1 With respect to your use of the Site, Monster+HotJobs is not to be considered to be an employer and is not responsible for any employment decisions, for whatever reason, made by any entity posting jobs on the Site.
6.2 The Site is only a venue. The Site acts as a venue for (i) Employers and/or Recruiters to post job opportunities and (ii) for Job Seekers to post their own résumés for the purpose of researching and evaluating job opportunities. Monster+HotJobs does not screen or censor the profiles or other information. Because user authentication on the Internet is difficult, Monster+HotJobs cannot and does not confirm that each user is who they claim to be. Monster+HotJobs expects that you will use caution and common sense when using the Site.
6.3 Job Seekers are solely responsible for the form, content, and accuracy of any résumé or material contained therein placed on the Site by such Job Seeker. Employers and Recruiters are solely responsible for their content posted on the Site.
6.4 Monster+HotJobs does not warrant or guarantee that a résumé or job listing will be viewed by any specific number of users, or that it will be viewed by any user.
6.5 Monster+HotJobs is not involved in the actual transaction between Employers and/or Recruiters and Job Seekers. As a result, Monster+HotJobs has no control over the quality, safety, or legality of the jobs or posted profiles, the truth or accuracy of the listings, the ability of Employers and/or Recruiters to offer job opportunities to Job Seekers, or the ability of Job Seekers to fill job openings. In addition, note that there are risks, including the risk of physical harm, of dealing with strangers, foreign nationals, underage persons, or people acting under false pretenses. You assume all risks associated with dealing with other users with whom you come in contact through the Site.
6.6 In addition, when using the Site, you are subject to any posted Yahoo! guidelines or rules applicable to such services, which may be posted from time to time. All such guidelines or rules (including but not limited to our Spam Policy) are hereby incorporated by reference into these Guidelines.
6.7 It is Monster+HotJobs' intention that only paying customers or prospective customers will have access to the résumé database, but Monster+HotJobs cannot guarantee that other parties will not, without Monster+HotJobs' consent, gain access to the database. Job Seekers may remove their résumé from the searchable database at any time. However, Employers and Recruiters who have paid for access to the database, and other parties who have otherwise gained access to the database, may have retained a copy of a Job Seeker résumé in their own files or databases. Monster+HotJobs is not responsible for the retention, use, or privacy of résumés in these instances, or for the use or privacy of résumés by any of such parties while résumés are in the database.
7. Patent, Trademark&Copyright Protection
7.1 The compilation (meaning the collection, arrangement and assembly) of all content on the Site is the exclusive property of Monster Worldwide,!
